AFTER THE TRIAL OF THE ACCUSED  IN THE CASE

MAAT CENTER DEMANDS THE RELEASE OF THE DETAINEES OF SINAI EXPLOSION

       Maat center received the news of the (martial and extraordinary) judgment's resolution to execute 3 accused persons and to imprison 10 others for a period between 5 and 25 years after being accused of arranging and implementing the terrorist explosions of October 2004 , of killing 34 persons and of carrying  out July 2005's explosions which  led to the killing of 64 persons .., with  caution and apprehension for the increasing number of the martial laws issued against civilians who did  not given the chance to stand before their ordinary judge , the fact which makes us doubt the justice of any judgment against them .

 

The Center , while being far from commenting on any judicial laws regardless of their nature, imagines that any other events like these terrorist explosions , due to which many have been punished, will  draw to (extraordinary) judgment's courts more innocent people who will be still under detention and investigation along with torture and punishment without the least legal evidence, but only with violating the  conception of extraordinary law , the law with which  one can not imagine the continuation of the extraordinary security work without supervisor or observer and with violating all the international  treaties and conventions which determine the period and the  limit of applying (extraordinary) cases and  which put the laws for working under it.

 

The extraordinary judgment's law that has been issued after more than 2 years shows that the State Security Supreme Court does not care about the self-determination of many of the victims. This court had been established under the extraordinary law under which these people were detained. So, the number of the tortured and the homeless persons exceeds , according to judicial reports , 3500 persons , most of which did not released in spite  of obtaining release judgments. This fact puts more than one question mark before applying the Court Martial's judgments of accusing citizens, while ignoring other judgments of their innocence and their rights to be released.

The Center sees that the rights of the victims of Sinai explosions and their relatives to be fairly trialed, are equal to the rights of compensating all those who have been detained after the explosions without any reasons as most of them are still under the administrative detention in spite of the fact that  the justifications of their detention were proved to be false after closing the case's  file . Therefore, the Center demands that these people must have been released. It also calls for the security policies to give up the policy of rising new generations of the detainees inside the jails, after the last repeated releases of the old and the leaders of 'Jihad' organizations.

Maat also raises an important question; is the timing of announcing the judgment has any relation to what  is declared by governmental and parliamentary characters about what will be included in the  proposed constitutional adjustments, among which is canceling the emergency law and enforcing a permanent one to fight terrorism. We expect that the coming few days would show the answer of this question , as the time of judging in other similar cases  is getting so near, and the  most important of these  cases is the case of El Azhar and Abdul Monem Riad 's explosions in April 2005 , due to which more than 2500 persons from Shubra El  Kheema and its districts were detained, displaced  and expelled to the farthest Egyptian prisons , in spite of the fact that  only 14 persons were accused  in these explosions , and they are now being trialed before the martial judgment without the least guarantees of fair trial , the guarantees that can be reassured by defence bodies and judicial activists and that can be admitted  by the constitutional traditions and the international conventions.
