Introduction

The Legislative And The Political Atmosphere Of The Elections

Egypt has witnessed this year a great event wasn’t expected since the revolution of July1952that’s the return of the regime from the royalty(kingdom)to the republic regime.

Egypt didn’t recognize since1952the system of the direct free elections to elect the president of the republic that’s to choose the president was by the enquiry upon the competitor that was the choose by(of)the parliament.

Mr. Mohamed HOSNEY MUBARAK used and practiced his right that’s authorized to him by the constitution according to the article no., 189as he suggested to the parliament to amend the article no., 76of the constitution.

This step is considered the most important achievement at Egypt since the returning back to the system of the multifarious political parties since1976.

We declare that, this step couldn’t be accomplished but by using and practicing Mr. president of the republic for his constitutional right to suggest amending some of the constitutional articles despite of that, the optimisms and the pessimisms we declared that we are optimistic then, as we said that, this is a step must be followed by another steps for reforming. Indeed we cant deny that, this amendment changed the atmosphere that was still there since more than50years and that, this amendment is considered as a start for amending the whole constitution despite of that, amending the article no., 76of the constitution and passing the law no., 174for2005about organizing the presidential elections, all of that were disappointing.

The demand of amending the constitution is still continuous since1986when the political parties and groups of Egypt prepared a charter under the title of(towards a new constitution).

They demanded and urged for electing the president of the republic by the direct free elections among more than a competitor, determining and restricting the authorities of the president and that he must not be elected for more than a twice of times(2of durations)and to abandon(freeze)all of his activities and his political parties properties along his duration of occupation for the position of the president of the republic.

The last demand of them was at the year of2004when the national united political parties were formed of15of the political parties, they gave a statement at September, 2004, the most important objective of them is to elect the president of the republic among more than a competitor and the demand of amending the constitution and to elect the president of the republic still a popular demand of the whole of the oppositions political parties and the civil society organizations.

Indeed, the reply was at26/02/2005when Mr. president of the republic declared that he suggested and demanded from the parliament to amend the article no., 76of the constitution, that it may be the cause of this reply, that the political forces pressures at Egypt and the increased international attention for the issues of the democracy and the political reform at Egypt and the whole of the Arab countries.

The legislative committee of the parliament prepared the suggestion of the amendment and a project of a law organizes the elections of the president of the republic, after the amendment was revised by the higher constitutional court that it returned back the law to the parliament and demanded to amend the articles no., 5,22,49,54,55because of that, the whole of them are infringing against the constitution and the both articles no., 13,18 for the suspicious of infringing the constitution.

The opposition and the objection(protest)at the article no., 5because it has replaced the most eldest of the representatives of the chairman of the court of appeal by the chairman of the higher constitutional court in case of that, if there is being any objection for him, as the court assured that, the must and the necessity that he must be replaced by his next(follower)at the court to be reserved 2 of members from(of)the constitutional court at the high committee.

The article no., 22before the amendment says that: the competitors(the applicants) for the presidency must not publicize their paid electoral advertisings at the media as the court has assured that there is no need for this context that’s because of there being a determined limit for the electoral advertisings.

The amendment of the article no., 49deleted and canceled the particular part for the financial punishment(sanction)for the competitors for the presidency(occupation) that’s assured and proved that, he has got or received foreign funds and that’s would be enough only the punishment(the sanction)of being jailed as the court has  considered that, the financial punishment(sanction)is infringing against the constitution.

Afterwards, the legislative committee of the parliament made the amendment and availed(introduced)the article for the enquiry of the people at25/05/2005that’s the historical day that’s because it is the day of the enquiry for the amendment for the article no., 76under the suggested proposal as the people(the nation)agreed also because it is the day of the violations against the women those who went out at a peaceful demonstration to express their opinion.

Afterwards the law no., 174for the year of2005was passed to organize the presidential elections this law is suspected at his infringing against the constitution as a lot of notices were marked upon it such as:

  • The context of the article no., 2of the before mentioned law says that: it is a must and a necessity to accept the application for competing for the presidential elections to be the competitor(the applicant)supported by250of the members at least of the elected members of the parliament of both its councils(the people and the consultants)and the local popular councils for the governorates on condition that(term) the supporters must not be less than65of the members of the council of people and25of the members of the council of the consultants and10of the members of each of local popular council for the governorate from14of the governorates at least, and the number of the  supporters of the members of the councils of people and the council of the consultants and the local popular councils of the governorates at the applications process must be increased according to the proportion of the increase at the number of the members of any of these councils as it is prohibited for any and every member of them to support more than a competitor for the presidency.
  • This context by this way restricting the opportunities for much more bigger number of the citizens to compete and to apply that’s because under the controlling over the whole process and the system(regime)from the national democrat party and its controlling over the councils of the people and the consultants and the local popular councils and its representation with the complete and the full majority ruining the amendment of the article no., 76 as a consequence there wouldn’t be any competitor but according to this majority that the national democrat party controlling over it. Constitutionally, this article is infringing against the context of the article no., 40of the constitution that says that:
  • (The citizens are equal in front of the law at the general(public)rights and duties without differences at all at this matter because of the sex(gender), race, language, religion, or the belief).
  • The article no., 3 of the law no., 174 for the year of 2005 said that:
  • The political parties that passed since it was established5continued years at least before declaring the start of the registration(application)process to elect the president of the republic as it was continued along this period of time (duration)at practicing its activity with its members obtaining at the last elections a proportion of5%at least of the elected seats at both of the councils of the people and the consultants its rightful to them to elect one of its members of its higher committee to compete and apply for the presidency of the republic according to its principal system(charter)whereas his membership at this committee must be continued for a complete year at least. Also this context is infringing against the article no., 40of the constitution.
  • The article no., 20determined the start of the election campaign for the competitors for the position of the president of the republic according to the start of the3weeks before the determined appointment for the voting process at the elections as the electoral advertisings are prohibited at any other appointments except these appointments by any mean(whatever the mean)the electoral advertising include the activities of the competitors or his supporters for persuading the voters to elect him throughout the private meetings and the general ones and the discussions, publishing and distributing the electoral advertisings putting on posters and the signs using the media radio or T.V and the printings and the electronic ones and the same to these activities that are legal(lawful)or by the decisions that are passed from the committee for the presidential elections.
  • If we revised this determined period(duration) for the advertisings according to this context we will find that it is so short time that the normal competitor wouldn’t be able to or even capable for covering the whole of the state with its cities and districts and its villages that the competitor couldn’t reach every and each governorate and city town or at least the major of them to show up his electoral program to persuade them for it.
  • If we compared between the competitor of the ruling party that’s supported by the whole of the state institutions and its employees to make it available the whole of the possibilities and the capabilities of them and between the rest of the competitors we could easily find the obvious and the clear difference as this is also infringing against the context of the article no., 40of the constitution.
  • This is about what's concerned to the legislative atmosphere but about the political atmosphere Egypt witnessed movements form the independents calling for not to extend the period(duration)of Mr. president Mohamed HOSNEY MUBARAK also that, interrupting some of the political parties for the elections.

  • 1st The competitors who Passed these uncompetitive elections:
  • There were10of the competitors representing10of the political parties they are:
  • 1-Mohamed HOSNEY MUBARAK.             1-the moon
  • 2-AYMAN Abdul-AZIZ NOUR.                   2-the palm-tree
  • 3-OSAMA Mohamed SHALTOUT.                3-the pyramid
  • 4-WAHEED PHAKHRY al-AKSOREY.                    4-the sun
  • 5-IBRAHEEM Mohamed Abdul-MONEAM Turk.     5-the lighthouse
  • 6-Ahmed al-SABBAHEY AWADUL-LAH.                6-the book
  • 7-Reafat Mohamed al-AGROUDEY.                           7-the lamp
  • 8- FAWZY KHALEEL GHAZAL.                              8-the cornflower
  • 9-Noaman KHALEEL GOMAA                                 9-the firelight

  • According to the monitoring process that’s declared that the proportion of the participation was23% that’s suspected because of the proportion of the participation wasn’t exceeded the proportion of18%at the best circumstances and so there are77% of the voters(those who are rightful and lawful to vote) they didn’t vote as the number of the voters at the lists that are rightful and lawful to vote reached the number of 32 million of the citizens, and the number of those who practiced their rights to vote indeed was according to the monitoring process that’s declared by the government7 of millions and 305 thousands of the citizens the national democrat party man obtained and got of them 6316704 of votes with a proportion of 88% and the competitor of al-gad political party obtained 540445 of votes and the competitor of al-WAFD political party obtained 208891 of votes.
  • Fieldwork monitoring for al-GIZA governorate:
  • Al-GIZA governorate is divided into17of the electoral constituencies at it about350of the election stations and merely about750of boxes, the number of the registered voters reaches about merely1/2million according to the monitoring process by our watchers and their evaluations that’s because there is not available any of the true or completed esthetics because of that, a lot of the constituencies our watchers couldn’t get in them to recognize the number of its registered voters at them and that, there were not any hanged lists outside the constituencies.
  • As we covered about75%of al-GIZA constituencies as the number of our watchers was242of watchers of them there was212of the sustainable watchers and22of the moving(touring)watchers, in addition to the watchers that, they were existing at the control room to receive the complains and to collect the forms.
  • Throughout our monitoring to the elections process at al-GIZA governorate there were a lot of the infringements and the violations that were monitored by our watchers but there were also positive points even if they were less(little) so that we will focus at1ston the positives afterwards we will show the negatives:
  • 1st: the positives:
  • 1- this is the 1st time Egypt witnesses a presidential elections that’s the positive itself even if it would produce its results at future.
  • The ministry of interiors didn’t interfere at this elections but rarely that the police haven’t any intensive existence around the electoral constituencies compared by the parliamentary elections.
  • The civil society organizations were monitoring the elections even if it was from outside the constituencies in addition to that some of the watchers could enter the constituencies and to attend the counting process such as at the constituencies of al-KOUM al-AHMAR and the constituency of (at)IMBABA industrial school.
  • The judges as some of them let the local watchers of the civil society organizations to enter the constituencies.
  • 2nd : the negatives and the infringements of the electoral day were so much, of them :
  • 1- the electoral advertisings continued for the competitor of the national democrat party man inside and outside the constituencies till the end of the electoral day and till we wrote this report.
  • 2- the secretaries of the national democrat party threatened the inhabitants(the voters)at their constituencies and at some of the constituencies they bought and corrupted the voters by giving them money or promising the voters by occupations. The secretaries of the national democrat party threatened the watchers by the financial punishments(sanctions) and to be jailed against those whose wouldn’t vote in good to the national democrat party man(competitor).
  • 3-the national democrat party members controlled over the lists of the voters at the most of the constituencies before the elections.
  • 4- the national democrat party members controlled over the divisions of the constituencies and the voting polls and its places(locations) and hide them as unknown for the rest of the competitors before the elections by enough time that made it easier to distribute their deputies and their printings, the guidance forms and cards for the supporters of the national democrat party man (competitor).
  • 5- the supervise committee for the presidential elections refused to implement the judgment of the justice to allow for the civil society organizations to enter the polls(stations) to watch(supervise)and to monitor as this is considered as an infringement and a violation against the law and the judgments of(from)the justice(the courts)as this is also is considered as an infringement and a violation against the constitution of the article no., 68 of it(the constitution)that says that: the must(the necessity) for the non-prohibition for any and every administrative decision that to not be prohibited(prevented) from the judicial supervision(review) but the committee said that: its decisions are prohibited to be revised(reviewed).
  • 6- there were not available any sum of the pink ink at some of the electoral constituencies that the fingers of the voters were not touched the ink at some of the constituencies as there were available the ink as we will mention those constituencies afterwards at this report.
  • 7- the voters didn’t recognize the places of the constituencies that’s because of collecting some of the subsidiary constituencies all together at general constituencies without declaring the places of the constituencies or the lists of the voters before the elections by enough time to make it easy to recognize the constituencies and its places as a consequence that a lot of the voters couldn’t reach their constituencies because that, they couldn’t recognize its places(locations)that means they didn’t vote because of that. Afterwards they went back to their homes(houses)without voting that may be the reason for the less(little)proportion of the participation.
  • 8- the state (governmental) institutions interfered at the electoral advertisings for(in good to) the national democrat party man(competitor)using the governmental buses (transportations) and also the parliamentarians (representatives) and those who intend to compete for the parliamentary seats(membership)of the businessmen.
  • GIZA police department:
  • It is included 27 of the polls, Mohamed ABUL-ININ, the parliament member could since the early morning to transport the voters by private transportations(buses)to the voting polls and stations for voting.
  • The major of the advertisings were for(in good to)the national democrat party man(competitor)and the appearance of(for) the rest of the political parties representatives was less(little).
  • The majority of the judges refused to allow the watchers(the monitors) to enter inside the voting polls as the elections were quite calm at the constituencies somehow and the proportion of the participation was at morning about15%and at the evening it was about5%.
  • GIZA police station:
  • This constituency includes 21of the subsidiary constituencies. The watchers were prohibited to enter the voting polls and the electoral constituencies. At some of the constituencies the watchers were prohibited also to stay outside the polls such as the polls of OSMAN Ben AFFAN. At the midday some of the watchers could recognize the number of the voters as they monitored the infringements and the violations that were existed at the polls of them, the spreading of the electoral advertisings of the national democrat party man(competitor)in and outside the polls.
  • Al-DOKKI constituency:
  • It is considered of the most important of the electoral constituencies.
  • MAAT center for the juridical and the constitutional studies covered 8of the polls(stations)at this constituency. MAAT center monitored throughout this process some of the infringements and the violations of some of the policemen while their dealings and treating the watchers and the deputies of the competitors, that the watchers were prohibited to talk(speak)to the voters or even to use the facilities of the school such as the toilet(W.C) that’s while that, the national democrat party men(members) were allowed to use the whole of the facilities as they were given the whole of the advantages such as to enter the polls(the stations) or to go out of them as they would like to as they were keeping the voters lists with only them, some of the national democrat party members distributed the electoral advertisings inside the polls such as the caps, badges, and the photos. The watchers also monitored that, the existence(being)of cars following(belonging) to the governmental institutions transporting the voters and also transportations belonging to private companies.
  • A member of(at)the national democrat party of the youths declared that for(to)our watcher that he came by force as he refused to declare his name because of that, he works at the project of the traffics at the governorate that’s because he was afraid to be disposed from his occupation.
  • Some of the electoral polls and stations that there were no curtains at them such as al-DOKKI Prepotary school for girls.
  • The whole polls at(of)al-DOKKI constituency that there were not allowed for whom doesn’t show his electoral(voting)card(certificate)to vote except at the poll at al-Imam Ali school that there were allowed for the voters to cast their votes by using the national number identity card.
  • The police forces were represented inside each poll by a Latinate and2of the police secretaries and2ofthe soldiers to reserve the order(discipline)in addition to that, the security of the state(national security)officer that were putting on(wearing)the civil costumes they were hardly to be discovered but it was easy for the watchers to recognize them by the end of this day according to their sustainable existence and their behaviors inside the polls.
  • The promises were spreading and distributed(declared)by the supporters of the national democrat party man(competitor) they were declaring for rewards(prizes)they were represented by(in)electric machines and opportunities for committing al-Hajj, occupying the idles and to give each voter some of money of 50of the Egyptian pounds.
  • At the school of the champion Abdul-MONEAM Riyadh, our watchers were prevented from entering as they allowed the supporters of the national democrat party man(competitor)to enter as they were putting on(wearing)the shirts that the photos of their man(competitor)were printed on them.
  • A female member of the local councils distributed advertisings, the photos of the national democrat party man(competitor)was printed over it and her photo of the school that she manage.
  • Our watchers recorded that, the cars of the ministry of interiors distributed meals(foods)for the national democrat party members and its supporters, as there were a poster on(over)the car says that: Cairo police officers club at al-MANYAL district the meal included: chicken, chipset, rice, appetizers, caned juice, bananas, biscuits. Generally the proportion of the participation was weak at al-DOKKI, the deputies of the other political parties have no existence inside the polls compared to the deputies of the national democrat party man(competitor).
  • At some of the polls, the voters of the members of the national democrat party were not touching the ink by their fingers to be able to vote for another time(illegal).
  • At the constituencies of BOLAK and al-OMRANEYAH:
  • That’s included 28of polls, MAAT center for the juridical and the constitutional studies covered them(monitored)at the poll of GAMAL Abdul- Nasser our watchers monitored that there was a definite(exact)box particularly for those whom voting against the national democrat party man(competitor)and their voting forms.
  • The national democrat party members were sustainable and continued existing and for much more long time inside the polls. Generally the proportion of the participation was less(little)and weak at the constituency of BOLAK but the electoral advertisings for(of)the national democrat party man(competitor)were spreading and distributed in and outside the polls as there were half-lorries of cars were carrying women and children sheering for(in good to)the national democrat party man(competitor)and against the competitor man of al-gad party.
  • Our watchers monitored also at al-KONAYESAH some of the voters who support the national democrat party man(competitor)they were not touching the ink by their fingers.
  • The national democrat party members were reserving the voters lists as they were entering inside the polls at the meanwhile that, the deputies were not allowed and were prohibited from entering despite of that, they were having deputations from the competitors.
  • Al-HARAM constituency:
  • MAAT center for the juridical and the constitutional studies covered 9of the polls at this constituency also the proportion of the participation was also weak(less) and little at the most of the polls, the voters were prohibited(prevented)from voting those whom didn’t show the electoral voting cards and identities.
  • Also that every and each person that, a mistake was found at his name was prevented and prohibited to vote even if the mistake was a letter or even a dot.
  • Our watchers at KAABEESH school faced infringements and violations against them by the police forces at morning but when the national security of the state officer came as our watcher showed his identity card to him the officer permitted him to stay(exist)but that would be outside of the poll as a condition.
  • The guidance card were spreading(distributed)by the national democrat party members for the voters, that the name of each voter was over them and his card (registration) number and the name and the symbol of their competitor.
  • At al-Sadat school also the popular musical bands(groups)were spreading sheering with and by the name of the national democrat party man(competitor) as the voters were transported by cars following and belonging to the parliamentarian member and one of the private schools owners at al-HARAM, they were both: al-MANDOUH al-HUSSEINY and NAFEA Abdul-HADY the parliamentarian member.
  • Our watchers monitored also an argument between the deputy of al-WAFD party and the deputy of the national democrat party because of the advertisings inside the polls as that’s considered as an infringement and a violation against the law.
  • At the city of the 6th of October our watchers monitored that the cars and the transportations of the big factories such as JUHAYNA factory were transporting the employees to the polls to vote in good to the national democrat party man(competitor) afterwards they would take them back again to the factory.
  • That happened at the poll of al-SHAMELAH school, also at al-sheikh ZAYED, that’s at the poll of al-SHAMELAH school, the deputy of al-WAFD party was prohibited and prevented to enter inside the poll despite of that he had got a deputation from the competitor of al-WAFD party.
  • IMBABA constituency:
  • We distributed 28 of the sustainable watchers and observers and3of the touring watchers of MAAT center for the juridical and the constitutional studies as the constituency of IMBABA and al-WARRAK was one of the most critical constituencies.
  • At some of the polls our watchers were allowed to enter and to even sit inside the polls also it was allowed for another organizations watchers to enter. At another polls the matter could turn easily to hit ad beat the watchers but the watchers have instructions to withdraw from the polls immediately as soon as there were starts for any serious troubles(situations) such as at the polls of KHALED Ben al-WALEED, OSMAN Ben AFFAN, and the modern school of IMBABA they were all suffering from intensive crowdedness and disorder and a great mass at the voting process.
  • The chairmen of the polls of judges were giving advantages to and for the national democrat party members that they were allowed to enter inside the polls as they only and the sole have got the voters lists and the guidance cards and no body else but them was permitted to do so.
  • Also the voters found difficulties at the voting process because they could hardly found their names at the polls as a consequence they had to search for their names at the other polls.
  • Thus, some of the voters didn’t vote because of this reason(difficulties).
  • IMBABA witnessed the much more advertisings by using the microphones and the half-lorries cars that carried the women and the children.
  • At the poll of IMBABA modern school, the elections process started at late time and the poll(the process) stopped for more than once because of the arguments between the deputies and the voters.
  • At the school of the labors town(primary) at IMBABA our watchers monitored there that in addition to the electoral advertisings in and outside the polls in good to the national democrat party man(competitor)that there were not there the voters names at he electoral lists that lead to a mass and crowdedness without real reasons.
  • At IMBABA prep school the national security officers existed obviously such as the officer ASHRAF al-KASHEF, the supporters of the competitor of al- gad were disposed from the whole of the poll(station)in addition to the electoral advertisings inside the school and over the walls.
  • At the poll of the national union(unity)school at al-WARRAK. Maat center for the juridical and the constitutional studies watchers monitored that, there were intensive electoral advertisings for the national democrat party man(competitor).
  • The distribution for meals and drinks for the voters and make the voting process easier to them on opposite to what was happened against the supporters of the other competitors.
  • Also there were cars carrying women and children sheering for and in good to the national democrat party man(competitor)and against the other competitors.
  • At al-Nile school at al-WARRAK our watcher was beaten by the national democrat party members as a consequence for that our watcher discovered the operation(process)of buying votes by the national democrat party secretary there.
  • AUSEEM constituency
  • MAAT institution covered 6of the polls there, we have monitored the phenomena  of the absence of a lot of the voters names at the voters lists a lot of the women hadn’t had the electoral cards(identity).
  • The electoral advertisings were spreading in good to the national democrat party man(competitor) in and outside the polls.
  • Also preventing the watchers from entering the polls or even monitoring the process from outside the polls. But a little number of them could watch from outside the polls.
  • Our watchers at al-HEDAYAH private school and the school of Betros faced some of the security restrictions.
  • At KERDASAH constituency:
  • We covered 7of the polls, at the poll of the old school at NAHYA the watchers monitored that, the mass at the voting process, the chairman judge went out of the poll more than once as he was talking with the national democrat party secretary as he left the poll for the employees without any revision.
  • As the voting process was ran without the electoral cards(identities)our representatives(watchers)watched and monitored at evening entering groups included about 3-6of the individual at once(altogether)inside the polls, some of the voters didn’t touch their fingers with the ink.
  • At al-MOATAMADEYAH primary school we found a voting form hanged on the door of the poll as this is considered as infringement and a violation against the laws and the regulations in addition to the phenomena of buying votes by an individual called Abdul-HAMEED we didn’t see him but the watcher heard somebody talking with someone else he said that: go to Abdul-HAMEED for and to be paid at 1st before you enter the poll.
  • Also while the counting process of the subsidiary poll no., 2 at the united and the collected unit at KERDASAH our watcher monitored that, while he was standing outside the poll, the process of filling in some of the voting forms and also another voices for competitors of the oppositions to the national democrat party man(competitor).
  • At the poll of KOMBO at KERDASAH the opposite voters to the national democrat party man(competitor)were prevented from casting their votes. In addition to that, the national democrat party secretary was spreading threatens and said that: who didn’t vote in good to the national democrat party man(competitor) that he would register an official statement against them to be punished by putting in jail(prison)in addition to the financial sanction that reaches an amount of money of 300 of the Egyptian pounds.
  • At al-HAWAMEDEYAH constituency:
  • We covered 8 of the polls, we have monitored through them that, the chairman judge refused at al-HAWAMEDEYAH secondary school for girls to let the watchers in, as he said that, he didn’t recognize the court judgment(order) and that he is the decision maker.
  • The national democrat party members were using the children at ad for distributing the electoral advertisings in and outside the polls.
  • At al-WEHDA school at um ATNAN, the national security officer(the watcher couldn’t recognize his name)made photocopies of and from his watching and his monitoring forms, afterwards he returned the sources back again to him as a type of terror and threatening to him.
  • At the religious institute school, the watcher monitored that there were great and a lot of the violations and the infringements form and committed by the national democrat party members and so as at the commercial secondary school and Arab al-SAHA, the members of the national democrat party were filling in the voting forms outside the polls, afterwards they entered with them completed and blanked they or their followers.
  • At al-BADRASHEEN constituency:
  • MAAT center(institute) for the juridical and the constitutional studies covered10 of the polls, it was so hard to recognize the number of the voters that’s because that the voters lists were not hanged outside the polls.
  • The national democrat party members and the local; officers were the only and the sole persons whom was permitted to have and get the voters lists and the guidance cards of and for the voters, in addition to that, the photos of the national democrat party man(competitor) were over the cards for guidance and the voters names and the place of their polls.
  • So that, the voters found a lot of and great difficulties at recognizing the polls.
  • The advertisings of and for the national democrat party man(competitor)were spreading also in and outside the polls.
  • The members of the national democrat party were permitted to enter or to go out the polls filling in the forms, on contrary that the deputies for the other competitors had no existence(they didn’t appear)or even any kind of representation.
  • At al-SAFF constituency:
  • It was the most of the electoral constituencies that witnessed mass and crowdedness, that the national democrat party was completely controlling over it, the national democrat party secretary was filling in the voting forms by the end of the electoral day, this constituency was characterized by the quite and the calm(it was peaceful)as there were not any kind of interference of the police security and that there were not any cases of violence.
  • There were not any competition from the other competitors, the electoral advertisings were filling the whole of the polls in and outside them in good to and for the national democrat party man(competitor).

Recommendations

  • MAAT center(institute)for the juridical and the constitutional studies recommends after its monitoring for the electoral process, its atmosphere and its consequences as follows:
  • 1- amending the article no., 76 of the constitution.
  • 2- amending the law no., 174 for the year of 2005 about the presidential elections, that gives the supervise committee for the elections authorities infringing and violating against the constitution and the law, particularly the articles no., 2,3,20,25.
  • 3- implementing the full judicial supervision on the whole of the elections process from its start(beginning)of preparing the electoral lists and dividing the constituencies and the polls and distributing them till we reach the counting process and also declaring the results.
  • 4- allowing and permitting the watchers and the observers of the civil society organizations to monitor and to enter the electoral polls.
  • 5- to prohibit and to prevent the national democrat party members and their secretaries from interfering at the electoral processes whatever their type and to not interfere also at the judicial and the police security affairs and duties.
  • 6- declaring the electoral polls and their locations and their types and the voters lists before enough time before the electoral processes.
  • 7- to prohibit the threatens or even to terror the citizens and that, to force them to vote for an exact competitor.
  • 8- we recommend that, the competitors must be committed to and with and they must be obliged by the rules of the electoral advertisings and the limits of its expenses and to prohibit to use the public facilities and the public funds at the electoral advertisings.
  • 9- to stand beside and to support(develop and promote)the judges and their independence that’s for and because their national bravery and their sacrifice to reach free, fair and clear elections and life.
  • 10- to prohibit the interferences of and from the police security institutions at any and every of the electoral processes but only for reserving the order and the discipline only outside the polls.
  • 11- the civil society organizations must work on rising and raising(increasing) the awareness for the political participation of the citizens and its importance as a matter of death or life.
  • 12- the supervise committees for the elections must work on and to proceed only according to the constitution and the law as a matter of death or life. In addition to that, the must of deleting and canceling any kind of restrictions could stand against reaching the free, fair and the clear elections and the must of ignoring any kind of instructions could stand against our sole hope.!!!
  • 13- the must of clearing and cleaning the electoral and the voters lists from the names of the dead and the passed citizens and also from the names of the employees whom working abroad and also from the repeated names.!!!
